TERMS AND CONDITIONS OF SALE OF FITNESS, BODYBUILDING AND STRENGTH TRAINING PRODUCTS

The following terms and conditions apply to all transactions on www.pullumsports.com or www.pullum-sports.co.uk .
The placing of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference. These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

We are now using the Sagepay online payment system to provide even more security in handling online transactions. As a result of this change your credit/debit card is charged for the items ordered as soon as you confirm your order.

We have the right to refuse at our discretion to supply any goods ordered by you.

Description of Goods/Warranty and Liability

All images, descriptive matter, specifications and advertising are for the sole purpose of giving an approximate description of the goods. Full details are available from the original manufacturer's brochures & websites. Except where the Customer is dealing as a consumer (as defined in the Unfair Contract Terms Act 1977, section 12) all other warranties, conditions or terms relating to fitness for purpose, merchantability or conditions of the goods whether implied by Statute, Common Law or otherwise are excluded and the Customer warrants that the Customer is satisfied as to the Suitability of the Goods for the Customer's purpose Goods are not sold on a trial basis.

Typographical Errors


In the event that a product is listed at an incorrect price due to a typographical error or error in pricing information from our suppliers, we shall have the right to refuse or cancel any orders based on the incorrect price whether or not the order has been confirmed.

Product Images / Specifications

Whilst we endeavour to ensure all images and specifications are correct at the time of publication, they do vary. As such we can accept no responsibility for incorrect images/information. If, however you spot a mistake with an image or with a products specification please let us know.

Payment Method

This is an international site. On the order you must provide us with your exact address and telephone number that your credit card issuer has on file for you. Your order will only be processed once authorisation of your credit card has been properly received.

Availability of Goods

All products are subject to availability and may be withdrawn at any time. However, it is our policy to contact you if a product is out of stock and if you do not wish to proceed with the order or for any reason we cannot supply the product we will arrange for the order to be cancelled. We offer an extended range of products which are obtained directly from our suppliers. These products are subject to suppliers' stock availability and delivery dates made by the suppliers' own delivery services. It is our policy to contact you to explain the stock and delivery situation with these products. If you do not wish to proceed with a non-custom order that has not been shipped, we will arrange for it to be cancelled.

Shipping

***Please note – All European orders will be shipped on a DAP service (‘Delivery At Place’) meaning that all taxes incurred when importing to the country of destination must be paid by the buyer or the recipient***

Orders will be shipped as per the address details provided by the customer. We are not responsible for mis-delivery caused by errors in these details. Orders returned because they could not be delivered will be refunded (less shipping charge).

Over 90% of online orders placed before midday (12 noon) are received the next working day. However, lead times and delivery may be longer during busy periods.

Longer dispatch lead times apply to manufactured items or items specified as required to be ordered from a supplier (such as 'custom' items' - made specifically for a customer. Further information is available on the relevant product pages.

Products will be delivered Monday to Friday during normal working hours 8am - 6pm (weekends by arrangement).

Please notify us of any delivery obstructions and ensure that the delivery area is clear.

Pallet deliveries are normally curb-side drop only (special arrangements for alternative delivery can be made upon written/email request).

All deliveries must be signed for on delivery and deliveries must be checked upon receipt.  Any damages or discrepancies must be notified within 24 hours of receipt of order.

We will endeavour to honour specific delivery dates upon request.

We cannot entertain any claim for compensation arising from late delivery due to a third-party carrier.


Delivery

Whilst every reasonable effort shall be made to keep to any delivery date. Time of delivery shall not be of the essence. We use third parties for deliveries and are therefore unable to guarantee a date or time.  We shall not be liable for any losses, costs, damages or expenses incurred by the Customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date or time.  Unless otherwise agreed we may deliver by instalments. This may incur a further agreed delivery charge.  Failure by the Customer to pay for any instalment or delivery when due shall entitle us to withhold further deliveries and the Customer shall be liable for any costs incurred by the Supplier relating to such Goods which the Supplier is then entitled to withhold. Delivery of the Goods shall be made to the Customer specified address and the Customer shall make all arrangements necessary to take delivery of the Goods.

Damaged in Transit

All goods must be examined carefully upon receipt. Should any damage be identified on opening a delivery, Pullum Sports Ltd. must be advised within 48 hours of the exact damage (with photographic evidence where possible). It is imperative that the Customer does not dispose of any of the packaging, as this will be required to affect a claim against the carrier. The claim will be handled by Pullum Sports Ltd., and an arrangement will be made to collect the damaged goods.  We cannot accept any claims for damage if the above time scales are not followed.

Shortages

It is the Customers responsibility to ensure the delivery is complete.  The Customer must notify us of any missing items within 48 hours of delivery. The Customer will be requested to provide us with a copy of the invoice as well. The matter will be investigated, and the Customer will be informed of the decision.

Incorrect Goods

It is the Customers responsibility to notify us of any incorrect goods supplied within 48 hours of delivery. If the items are not as ordered, the Customer must NOT open the packaging or use the item. The Customer will also be required to provide further information on what was received.

Non-Deliveries

Customers must inform us within 14 days from when the item(s) are despatched.  We shall accept no liability for shortages, non-deliveries, incorrect goods and goods damaged on delivery outside the reported timescales.

Returns

Before sending anything back to us - you need to contact us by phone (01582 560555) or email (custserv@pullumsports.com) for a Returns Number. You must include this returns number (on a copy of the invoice) and send it back along with your goods for refund within 28 days of receipt of goods.

Goods must be new/unused condition with no blemishes, defects or parts missing, and in their original packaging (which must not show any damage nor be defaced in any way).

Any used goods/products, ones which are not in original packaging, or which are outside of the 28-day timeframe will not be accepted.

Items which are ordered in especially for customers or which are made to order (all Pullum branded Gym Equipment) are subject to a 25% re-stocking fee. Custom made equipment or clothing are non-refundable.

Product Guarantees

Unless otherwise stated, items come with a 12-month manufacturer’s warranty. In the event of any claim, in the first instance all enquiries must be directed to Pullum Sports Ltd. who will liaise with the manufacturer if necessary.  This does affect your statutory rights.

Our manufactured items are guaranteed for normal use, when installed and used properly, from the date of delivery, as follows…

10 Years: frames, welds

2 Years: pulleys, bearings, platforms, weight plates

1 Year: cables, upholstery, grips.

This excludes fair wear and tear.
